  97. END-USER LICENSE AGREEMENT FOR SONY SOFTWARE

  99. IMPORTANT-READ CAREFULLY:  This End-User License Agreement
  100. ("EULA") is a legal agreement between you and Sony Electronics 
  101. Inc. ("SONY"), the manufacturer of your Sony digital still camera
  102.  ("CAMERA") or Sony digital camcorder ("CAMCORDER")  All Sony 
  103. software and third party software distributed together with the 
  104. CAMERA or the CAMCORDER  shall be referred to herein as the SONY 
  105. SOFTWARE.  This EULA covers only the SONY SOFTWARE .  
  106. The SONY SOFTWARE includes computer software, the associated 
  107. media, any printed materials, and any "on-line" or electronic 
  108. documentation. You may use the SONY SOFTWARE only in connection 
  109. with the use of the CAMERA or the CAMCORDER.  By installing, 
  110. copying or otherwise using the SONY SOFTWARE, you agree to be 
  111. bound by the terms of this EULA.  If you do not agree to the 
  112. terms of this EULA, SONY is unwilling to license the SONY 
  113. SOFTWARE  to you.  In such event, you may not use or copy the 
  114. SONY SOFTWARE , and you should promptly contact SONY for 
  115. instructions on return of the unused product(s) for a refund of 
  116. the purchase price of the CAMERA or CAMCORDER allocable to the 
  117. SONY SOFTWARE.
  118.  
  119. LICENSE
  120. The SONY SOFTWARE is protected by copyright laws and 
  121. international copyright treaties, as well as other intellectual 
  122. property laws and treaties.  The SONY SOFTWARE is licensed, not 
  123. sold.
  124.  
  125. GRANT OF LICENSE.  This EULA grants you the following rights:
  126. -     Software.  You may install and use one copy of the SONY 
  127. SOFTWARE on a single computer.
  128. -    Storage/Network Use.  You may not use the SONY SOFTWARE 
  129. over an internal network or distribute the SONY SOFTWARE to other 
  130. computers over an internal network.
  131. -    Back-up Copy.    You may  make one back-up copy of SONY 
  132. SOFTWARE solely for archival purposes.
  133.  
  134. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
  135. -    Limitation on Reverse Engineering, Decompilation and 
  136. Disassembly.  
  137. You may not modify, reverse engineer, decompile, or disassemble 
  138. the SONY SOFTWARE in whole or in part.
  139. -    Separation of Components.  The SONY SOFTWARE is licensed 
  140. as a single product.  Its component parts may not be separated 
  141. for use on more than one computer.
  142. -    Single COMPUTER.    The SONY SOFTWARE may only be used 
  143. with a single computer.
  144. -    Rental.  You may not rent or lease the SONY SOFTWARE.
  145. -    Software Transfer.  You may permanently transfer all of 
  146. your rights under this EULA only as part of a sale or transfer 
  147. of the SONY SOFTWARE along with the CAMERA or the CAMCORDER, 
  148. provided you retain no copies, transfer all of the SONY SOFTWARE 
  149. (including all copies, component parts, the media and printed 
  150. materials, all versions and any upgrades of the SONY SOFTWARE 
  151. and this EULA), and the recipient agrees to the terms of this 
  152. EULA.
  153. -    Termination.  Without prejudice to any other rights, 
  154. SONY may terminate this EULA if you fail to comply with the 
  155. terms and conditions of this EULA.  In such event, you must 
  156. destroy all copies of the SONY SOFTWARE and all of its 
  157. component parts.
  158.  
  159. COPYRIGHT.  All title and copyrights in and to the SONY SOFTWARE 
  160. (including but not limited to any images, photographs, animation, 
  161. video, audio, music, text and "applets," incorporated into the 
  162. SONY SOFTWARE), and any copies of the SONY SOFTWARE, are owned 
  163. by SONY or its suppliers.  
  164. All rights not specifically granted under this EULA are reserved 
  165. by SONY.

  167. HIGH RISK ACTIVITIES.  The SONY SOFTWARE is not fault-tolerant 
  168. and is not designed, manufactured or intended for use or resale 
  169. as on-line control equipment in hazardous environments requiring 
  170. fail-safe performance, such as in the operation of nuclear 
  171. facilities, aircraft navigation or communication systems, air 
  172. traffic control, direct life support machines, or weapons 
  173. systems, in which the failure of the SONY SOFTWARE could lead 
  174. to death, personal injury, or severe physical or environmental 
  175. damage ("High Risk Activities").  SONY and its suppliers 
  176. specifically disclaim any express or implied warranty of 
  177. fitness for High Risk Activities.

  179. PROHIBITION ON EXPORT.  EXCEPT FOR EXPORT TO CANADA FOR USE IN 
  180. CANADA BY CANADIAN CITIZENS, THE SONY SOFTWARE AND ANY 
  181. UNDERLYING TECHNOLOGY MAY NOT BE EXPORTED OUTSIDE THE UNITED 
  182. STATES OR TO ANY FOREIGN ENTITY OR "FOREIGN PERSON" AS DEFINED 
  183. BY U.S.  GOVERNMENT REGULATIONS, INCLUDING WITHOUT LIMITATION, 
  184. ANYONE WHO IS NOT A CITIZEN, NATIONAL OR LAWFUL PERMANENT 
  185. RESIDENT OF THE UNITED STATES.  BY DOWNLOADING OR USING THE SONY 
  186. SOFTWARE, YOU ARE AGREEING TO THE FOREGOING AND YOU ARE 
  187. WARRANTING THAT YOU ARE NOT A "FOREIGN PERSON" OR UNDER THE 
  188. CONTROL OF A FOREIGN PERSON.

  190. U.S. GOVERNMENT RESTRICTED RIGHTS.  THE SOFTWARE PRODUCT and 
  191. documentation are provided with RESTRICTED RIGHTS.  Use, 
  192. duplication, or disclosure by the United States Government is 
  193. subject to restrictions as set forth in subparagraph (c)(1) and 
  194. (2) of the Commercial Computer Software-Restricted Rights at 48 
  195. CFR 52.227-19, as applicable.

  201. LIMITED WARRANTY ON CD-ROM MEDIA.  SONY warrants that for a 
  202. period of ninety (90) days from the date of its delivery to you 
  203. the CD-ROM media on which the SONY SOFTWARE is furnished to you 
  204. will be free from defects in materials and workmanship under 
  205. normal use.  This limited warranty extends only to you as the 
  206. original licensee.  SONY's entire liability and your exclusive 
  207. remedy will be replacement of the CD-ROM media not meeting 
  208. SONY's limited warranty and which is returned to SONY with proof 
  209. of purchase in the form of a bill of sale (which is evidence that 
  210. the CD-ROM media is within the warranty period). SONY will have 
  211. no responsibility to replace a disk damaged by accident, abuse or 
  212. misapplication.  ANY IMPLIED WARRANTIES ON THE CD-ROM MEDIA, 
  213. INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS 
  214. FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO NINETY (90)

  224. warranty of any kind and SONY and SONY's licensors (hereinafter, 
  225. SONY and SONY's licensors shall be collectively referred to as 
  226. "SONY")  EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, 
  227. INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF 
  228. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  SONY DOES 
  229. NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SONY SOFTWARE

  235. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SONY OR A SONY 
  236. AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY OR IN ANY WAY

  238. SHOULD THE SONY SOFTWARE PROVE DEFECTIVE YOU (AND NOT SONY OR A 
  239. SONY AUTHORIZED REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL 
  240. NECESSARY SERVICING, REPAIR OR CORRECTION.  SOME JURISDICTIONS

  273. IMPORTANT-READ CAREFULLY: This End-User License Agreement 
  274. ("EULA") is a legal agreement between you and Sony Corporation 
  275. (hereinafter referred to as "SONY"), a corporation organized 
  276. under Japanese Law, the manufacturer of your Sony digital still 
  277. camera (the "CAMERA") or Sony digital camcorder (the 
  278. "CAMCORDER"). Please read this EULA carefully before installing 
  279. or using the software distributed together with the CAMERA or 
  280. the CAMCORDER (the "SONY SOFTWARE"). By installing or using the 
  281. SONY SOFTWARE, you agree to be bound by the terms of this EULA. 
  282. You may use the SONY SOFTWARE only in connection with the use of 
  283. a single computer. SONY SOFTWARE is licensed not sold.

  289. License.   The SONY SOFTWARE and the related documentation are 
  290. licensed to you by SONY. This EULA allows you to use the SONY 
  291. SOFTWARE for your personal use and only to make one copy of the 
  292. SONY SOFTWARE in machine-readable form for back-up purposes only.

  294. Restrictions.  The SONY SOFTWARE contains copyrighted material 
  295. and other proprietary material. In order to protect them, and 
  296. except as permitted by applicable law, you may not decompile, 
  297. reverse engineer or disassemble the SONY SOFTWARE in whole or 
  298. in part. You may permanently transfer all of your rights under 
  299. this EULA only as part of a sale or transfer of the SONY SOFTWARE
  300. along with the CAMERA or the CAMCORDER, provided you retain no 
  301. copies, transfer all of the SONY SOFTWARE (including all copies,
  302. component parts, the media and printed materials, all versions 
  303. and any upgrades of the SONY SOFTWARE and this EULA), and the 
  304. recipient agrees to the terms of this EULA. 
  305.  
  306. Limited Warranty.  SONY warrants the media on which the SONY 
  307. SOFTWARE is recorded to be free from physical defects for a 
  308. period of ninety (90) days from the date of purchase as evidenced
  309. by a copy of the receipt. During the applicable warranty period, 
  310. SONY will replace free of charge such media that proved to be 
  311. defective;  provided they are returned properly packaged to the 
  312. place where you obtained it, together with your name, address, 
  313. and proof of date of purchase. SONY will have no responsibility 
  314. to replace media damaged by accident, abuse, or misapplication. 
  315.  
  316. The above limited warranty replaces all other representations, 
  317. conditions and warranties, whether express or implied, by 
  318. statute or otherwise and SONY expressly disclaims all other 
  319. warranties and all conditions including, but not limited to, 
  320. the implied warranties and/or conditions of satisfactory quality 
  321. and fitness for a particular purpose. The terms of this limited 
  322. warranty do not affect or prejudice your statutory rights as an 
  323. ultimate consumer, neither do they limit or exclude any 
  324. liability for death or personal injury caused by the negligence 
  325. of SONY.

  327. Termination.  This EULA is effective until terminated. You may 
  328. terminate this EULA at any time by destroying the SONY SOFTWARE, 
  329. related documentation, and all copies thereof. This EULA will 
  330. terminate immediately without notice from SONY, if you fail to 
  331. comply with any provision of this EULA. Upon termination you 
  332. must destroy the SONY SOFTWARE, related documentation, and all 
  333. copies thereof.

  335. Governing Law. This EULA shall be governed by and construed in 
  336. accordance with the laws of Japan.

  352. ("SONY"), the manufacturer of your Sony digital still camera 
  353. ("CAMERA") or Sony digital camcorder ("CAMCORDER")  All Sony 
  354. software and third party software distributed together with the 
  355. CAMERA or the CAMCORDER  shall be referred to herein as the SONY 
  356. SOFTWARE.  This EULA covers only the SONY SOFTWARE .  The SONY 
  357. SOFTWARE includes computer software, the associated media, any 
  358. printed materials, and any "on-line" or electronic documentation.
  359. You may use the SONY SOFTWARE only in connection with the use of 
  360. the CAMERA or the CAMCORDER.  By installing, copying or 
  361. otherwise using the SONY SOFTWARE, you agree to be bound by the 
  362. terms of this EULA.  If you do not agree to the terms of this 
  363. EULA, SONY is unwilling to license the SONY SOFTWARE  to you.  
  364. In such event, you may not use or copy the SONY SOFTWARE , and 
  365. you should promptly contact SONY for instructions on return of 
  366. the unused product(s) for a refund of the purchase price of the 
  367. CAMERA or CAMCORDER allocable to the SONY SOFTWARE.

  369. LICENSE
  370. The SONY SOFTWARE is protected by copyright laws and 
  371. international copyright treaties, as well as other intellectual 
  372. property laws and treaties.  The SONY SOFTWARE is licensed, not 
  373. sold.
  374.  
  375. GRANT OF LICENSE  
  376. This EULA grants you the following rights:
  377. -     Software.  You may install and use one copy of the SONY 
  378. SOFTWARE on a single computer.
  379. -    Storage/Network Use.  You may not use the SONY SOFTWARE 
  380. over an internal network or distribute the SONY SOFTWARE to 
  381. other computers over an internal network.
  382. -    Back-up Copy.    You may  make one back-up copy of SONY 
  383. SOFTWARE solely for archival purposes.
  384.  
  385. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
  386. -    Limitation on Reverse Engineering, Decompilation and 
  387. Disassembly.  You may not modify, reverse engineer, decompile, 
  388. or disassemble the SONY SOFTWARE in whole or in part.
  389. -    Separation of Components.  The SONY SOFTWARE is licensed 
  390. as a single product.  Its component parts may not be separated 
  391. for use on more than one computer.
  392. -    Single COMPUTER.    The SONY SOFTWARE may only be used 
  393. with a single computer.
  394. -    Rental.  You may not rent or lease the SONY SOFTWARE.
  395. -    Software Transfer.  You may permanently transfer all of 
  396. your rights under this EULA only as part of a sale or transfer 
  397. of the SONY SOFTWARE along with the CAMERA or the CAMCORDER, 
  398. provided you retain no copies, transfer all of the SONY SOFTWARE 
  399. (including all copies, component parts, the media and printed 
  400. materials, all versions and any upgrades of the SONY SOFTWARE 
  401. and this EULA), and the recipient agrees to the terms of this 
  402. EULA.
  403. -    Termination.  Without prejudice to any other rights, 
  404. SONY may terminate this EULA if you fail to comply with the 
  405. terms and conditions of this EULA.  In such event, you must 
  406. destroy all copies of the SONY SOFTWARE and all of its 
  407. component parts.

  409. COPYRIGHT.  All title and copyrights in and to the SONY SOFTWARE 
  410. (including but not limited to any images, photographs, animation,
  411. video, audio, music, text and "applets," incorporated into the 
  412. SONY SOFTWARE), and any copies of the SONY SOFTWARE, are owned 
  413. by SONY or its suppliers.  All rights not specifically granted 
  414. under this EULA are reserved by SONY.

  416. HIGH RISK ACTIVITIES.  The SONY SOFTWARE is not fault-tolerant 
  417. and is not designed, manufactured or intended for use or resale 
  418. as on-line control equipment in hazardous environments requiring 
  419. fail-safe performance, such as in the operation of nuclear 
  420. facilities, aircraft navigation or communication systems, air 
  421. traffic control, direct life support machines, or weapons 
  422. systems, in which the failure of the SONY SOFTWARE could lead to 
  423. death, personal injury, or severe physical or environmental 
  424. damage ("High Risk Activities").  SONY and its suppliers 
  425. specifically disclaim any express or implied warranty of fitness 
  426. for High Risk Activities.

  428. LIMITED WARRANTY
  429.  
  430. LIMITED WARRANTY ON CD-ROM MEDIA.  SONY warrants that for a 
  431. period of ninety (90) days from the date of its delivery to you 
  432. the CD-ROM media on which the SONY SOFTWARE is furnished to you 
  433. will be free from defects in materials and workmanship under 
  434. normal use.  This limited warranty extends only to you as the 
  435. original licensee.  SONY's entire liability and your exclusive 
  436. remedy will be replacement of the CD-ROM media not meeting 
  437. SONY's limited warranty and which is returned to SONY with proof 
  438. of purchase in the form of a bill of sale (which is evidence 
  439. that the CD-ROM media is within the warranty period). SONY will 
  440. have no responsibility to replace a disk damaged by accident, 
  441. abuse or misapplication.  ANY IMPLIED WARRANTIES ON THE CD-ROM 
  442. MEDIA, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND 
  443. FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO

  445. ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO

  451. acknowledge and agree that use of the SONY SOFTWARE is at your 
  452. sole risk.  The SONY SOFTWARE is provided "AS IS" and without 
  453. warranty of any kind and SONY and SONY's licensors (hereinafter, 
  454. SONY and SONY's licensors shall be collectively referred to as 
  455. "SONY")  EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, 
  456. INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF 
  457. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  SONY DOES 
  458. NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SONY SOFTWARE 
  459. WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE SONY 
  460. SOFTWARE WILL BE CORRECTED.  FURTHERMORE, SONY DOES NOT WARRANT 
  461. OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF 
  462. THE USE OF THE SONY SOFTWARE IN TERMS OF ITS CORRECTNESS, 
  463. ACCURACY, RELIABILITY, OR OTHERWISE.  NO ORAL OR WRITTEN 
  464. INFORMATION OR ADVICE GIVEN BY SONY OR A SONY AUTHORIZED 
  465. REPRESENTATIVE SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE 
  466. THE SCOPE OF THIS WARRANTY.  SHOULD THE SONY SOFTWARE PROVE 
  467. DEFECTIVE YOU (AND NOT SONY OR A SONY AUTHORIZED REPRESENTATIVE) 
  468. ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR 
  469. CORRECTION.  SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF 
  470. IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

  472. LIMITATION OF LIABILITY
  473. HEREINAFTER, SONY AND SONY'S LICENSOR'S SHALL BE COLLECTIVELY 
  474. REFERRED TO AS "SONY."  SONY SHALL NOT BE LIABLE FOR ANY 
  475. INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY EXPRESS OR 
  476. IMPLIED WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT 
  477. LIABILITY OR ANY OTHER LEGAL THEORY RELATED TO THIS PRODUCT.   
  478. SUCH  DAMAGES INCLUDE, BUT ARE NOT LIMITED TO , LOSS OF PROFITS, 
  479. LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE OF THE PRODUCT OR ANY 
  480. ASSOCIATED EQUIPMENT, DOWN TIME AND USER'S TIME, EVEN IF SONY 
  481. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  IN ANY 
  482. CASE,  SONY'S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA 
  483. SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID ALLOCABLE TO THE 
  484. SONY SOFTWARE.  SOME STATES DO NOT ALLOW THE EXCLUSION OR 
  485. LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE 
  486. EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU.
